We Have, for instance, a bond binding Sampson Wase, of Rotherby, gentleman, 1597, reciting that in consideration of a marriage to be had between Henry Fox, son of Thomas Fox, of Wigston, husbandman, and Margaret, daughter of Thomas Wase, has covenanted to procure the payment of 200 pounds to Thomas Fox before the celebration of the marriage and that Thomas Fox on his side, has made over to Margaret Wase an estate of his two yardlands, and apparantly other property of his. Sampson Wase, brother of Margaret, binds himself in the sum of 200 pounds to Thomas Fox that Margaret " Shall not hereafter at any time surrender, yield up, or otherwise depart with her estate or interest (or any part thereof) in that messuage or tenement and two yardlands with the appurtenance and all other customary lands and tenements of the said Thomas Fox, in Wigston Magna aforesaid now being tenure or occupation of Thomas Fox or his assignee or assignees, or any part therof unless it be some or one of the children of the said Henry Fox " . If Margaret should keep her side of the bargain the obligation of Samson Wase to pat Thomas Fox 200 pound shall be void.
